检察机关应践行行政公益诉讼

我国司法界多位官员和学者指出，我国15年前颁布实施的《行政诉讼法》，其制度安排难以完全适应今天的现实需要，迫切需要进一步加以修改与完善。其中，拓宽原告资格，增加行政公益诉讼也成了学者讨论的一个热点。（《中国青年报》4月5日）
行政公益诉讼是指出于维护公共利益的需要，在公共利益受到违法的行政作为或不作为情形下，提起的行政诉讼。在目前我国现有的法律规定下，公民和社会团体提起的行政公益诉讼面临着法律上原告资格的障碍。依照我国现行的法律和司法解释，行政诉讼的原告必须是行政行为的相对人或与具体行政行为有法律上利害关系的当事人，而在违法行政行为侵犯的是不特定的多数人或没有特定的受害人只是公共利益时，一般公民和社会团体就没有原告的资格。
然而，现实却呼唤行政公益诉讼。2000年10月，浙江省台州市著名画家严正学就状告台州市椒江区文体局纵容支持歌舞厅、夜总会在小学校门口经营，并为色情表演提供场地。法院就以严正学与具体行政行为无法律上的利害关系，驳回其的诉讼请求。现实的需要与法律的规定凸显矛盾。
在这种情形下，笔者认为，在法律还没有修改以前，检察机关应当首先践行行政公益诉讼，为法律的修改摸索道路。首先，从理论上讲，检察机关是国家和社会公共利益的代理人，那么行政机关的具体行政行为侵犯公共利益时，检察机关应当被认为是与具体行政行为有法律上利害关系的当事人；其次，检察机关是国家的法律监督机关，《中华人民共和国行政诉讼法》第十条也规定，人民检察院有权对行政诉讼实行法律监督，所以说监督行政机关依法行政也是检察机关义不容辞的责任。所以说，尽管法律上对于行政公益诉讼没有具体规定，但检察机关担当行政公益诉讼不存在理论和法律上的障碍，至少不违反法律的强制性规定，反而，由检察机关先行担当行政公益诉讼有利于保护社会公共利益，促进行政机关依法行政，推进行社会的文明进步，并为行政公益诉讼制度的正式建立打下扎实的基础。
在世界各国，行政公益诉讼都是一种正式的行政诉讼制度。在英国，检察总长代表国王，有权阻止一切违法行为，代表公共利益可以主动请求对行政行为实施司法审查，还可以在私人没有起诉资格时帮助私人申请司法审查，即检察长是原告，公民列为告发人。在德国也有类似的规定，域外的成功经验可以作为我们推行这项制度的借鉴。
因此，笔者认为，我们不仅要期待立法机关更多地征求民意，尽快修改法律，增加行政公益诉讼这一行政诉讼类型。我们也期待司法机关在法无明文规定亦不禁止时，在有利于社会文明进步的前提下，多做一些有益的摸索和改革，检察机关在行政公益诉讼的问题上应当身体力行，为制度的建立添砖加瓦。
